Acceptable Use Policy

This Acceptable Use Policy (this "AUP") governs your use of HPDash Remote. It is incorporated into, and forms part of, the HPDash Remote Terms of Service (the "Terms"), and is read together with the HPDash Remote Privacy Policy and the HPDash Remote End User License Agreement (the "EULA"). By accepting the Terms, installing the Software, creating an account, or otherwise using the Service, you agree to be bound by this AUP. If you do not agree, do not use HPDash Remote.
Capitalized terms not defined in this AUP have the meaning given to them in the Terms.
1. Definitions
For purposes of this AUP:
- "HPDash," "we," "us," and "our" mean HPDash, LLC.
- "Service" means the HPDash-hosted relay and gateway that brokers the encrypted connection between an Operator Client and an Agent. For Customers using the Self-Host option, "Service" also includes the gateway software provided for the Customer to operate.
- "Software" means the HPDash Remote Agent and the Operator Clients (the Windows desktop client and the Android client). For this AUP, the Terms, and the EULA, this definition of "Software" supersedes any more general definition of "Software" used elsewhere on the Site.
- "Agent" means the HPDash Remote program installed on a computer so that it can be remotely accessed.
- "Operator Client" means the HPDash Remote application a technician uses to view or control an Agent machine.
- "Customer," "you," and "your" mean the business or individual that purchases, registers for, or uses HPDash Remote.
- "Operator" means an individual authorized by the Customer to use the Software under the Customer's account, including under a licensed operator seat.
- "Unit" or "Accessed Machine" means a computer on which an Agent is installed and which is accessed through the Service.
- "Owner" means the Customer's account administrator, and, where the context requires, the owner of a Unit.
2. Authorization and Consent (Core Requirement)
HPDash Remote is a tool for authorized remote access only. This Section is a material condition of your right to use the Service and the Software.
For every Unit you connect to, attempt to connect to, or install an Agent on, you represent and warrant, each time you connect and on a continuing basis, that:
- you own the Unit, or you are authorized by the Unit's owner to access and control it through HPDash Remote;
- you have obtained, and continue to hold, all consents and authorizations required by applicable law from the Unit's owner and from every individual who uses or may use the Unit, for the access, control, viewing, file transfer, terminal access, unattended access, audio listening, two-way calling, reboot, shutdown, and any other capability you exercise;
- the persons who use the Unit are aware that the Unit can be remotely accessed through HPDash Remote and that the Agent is installed; and
- your access and use comply with all applicable laws, including laws governing computer access, electronic communications, privacy, and recording.
You are solely responsible for determining what authorizations and consents are required for your use and for obtaining and maintaining them. You will provide evidence of authorization and consent to us promptly on request. We do not verify, and are not responsible for verifying, whether you are authorized to access any Unit. Connecting to a Unit you are not authorized to access, or installing an Agent without the required consents, is a serious violation of this AUP and may also violate federal and state law, including the Computer Fraud and Abuse Act, the Electronic Communications Privacy Act, and state computer-crime, anti-stalking, and wiretap statutes.
This authorization-and-consent representation is also made in Section 14 of the Terms and, at install time, in Section 4 of the EULA. The representations are cumulative and apply each time you install, connect, or use the Software.
3. Transparent, Identifiable Installation Required
The Agent is designed to be identifiable and removable and to run with a visible, consented presence. The unattended Agent runs as a Windows service and is identifiable and removable; it is not designed to be hidden. You agree:
- to install and operate the Agent transparently, so that a reasonable user or owner of the Unit can discover that the Unit is configured for remote access through HPDash Remote;
- not to install, configure, rename, repackage, or operate the Agent so as to hide, disguise, or conceal its presence, its name, or the fact that the Unit can be remotely accessed;
- not to remove, suppress, or interfere with any notice, indicator, or other element intended to disclose the Agent's presence or that a remote session is or may be active; and
- not to represent the Agent to any person as a different program, or as something other than remote-access software.
Use of HPDash Remote as, or as a component of, "stalkerware," "spyware," or any covert monitoring tool is strictly prohibited.
4. Prohibited Uses
You will not, and will not permit any Operator or other person to, use the Service or the Software to:
- access, or attempt to access, any Unit, system, account, network, or data without authorization, or in excess of your authorization;
- install, configure, or operate an Agent covertly or surreptitiously, or to access a Unit without the knowledge and consent of its owner and users;
- conduct stalkerware, spyware, or covert monitoring, including monitoring or surveilling an employee, contractor, spouse, partner, family member, or any other person, without the disclosure and consent required by applicable law;
- intercept, monitor, listen to, or record communications, screen activity, keystrokes, audio, or other data in violation of any applicable wiretap, eavesdropping, electronic-communications, or privacy law (see Section 5 regarding the Audio and Calling features);
- violate any applicable law or regulation, or facilitate any illegal activity;
- engage in or facilitate fraud, scams, phishing, social engineering, identity theft, or other deceptive or unlawful schemes;
- harass, threaten, stalk, defame, abuse, or intimidate any person, or invade any person's privacy;
- infringe or misappropriate any third party's intellectual-property, privacy, publicity, or other rights, or store, transfer, or distribute infringing or unlawful content;
- transmit, store, or distribute malware, ransomware, spyware, or other malicious code, or interfere with or disrupt any network, system, device, or service;
- probe, scan, test, bypass, disable, or circumvent any security feature, authentication measure, encryption, capability gate, or technical-protection measure of the Service, the Software, a Unit, or any third-party system, or otherwise attack or attempt to compromise the Service or any third party;
- resell, sublicense, rent, lease, lend, or commercially exploit the Service or the Software, or provide access to it, except as expressly authorized in writing by HPDash;
- exceed, or attempt to exceed, the operator seats or unit-pool capacity for your subscription tier, including by sharing a single login or set of credentials among multiple individuals beyond the number of licensed seats; or
- take any action that imposes an unreasonable or disproportionate load on the Service, or that interferes with any other customer's use of the Service.
The prohibitions in this Section apply regardless of whether you operate the Service through HPDash's hosted gateway or under the Self-Host option.
5. Audio and Calling — All-Party Consent Notice
HPDash Remote includes optional features that allow an Operator to listen to audio from a Unit and to open the Unit's microphone for two-way calling. Many jurisdictions, including approximately a dozen U.S. states, require the consent of all parties before a communication may be recorded, listened to, or intercepted.
Before using the audio listening or two-way calling features, you must comply with all applicable federal and state wiretap, eavesdropping, and recording laws, including any all-party (two-party) consent requirements. You are responsible for determining which laws apply and for obtaining the consent of every party to a communication before listening to, monitoring, or recording it through the Service. You will not use these features to intercept, monitor, or record any communication without the consent required by law.
6. Responsibility for Operators and Credentials
You are responsible for all activity that occurs under your account and through your licensed seats, including the acts and omissions of every Operator and of anyone who uses your credentials. You will keep account and connection credentials confidential, will not share them beyond your licensed seats, and will promptly notify us at legal@hpdash.com or report@hpdash.com of any suspected unauthorized access or use. A violation of this AUP by an Operator or other person acting under your account is a violation by you.
7. Enforcement
We may, at any time and in our sole discretion, investigate any suspected violation of this AUP. In connection with an investigation or a violation, and to the extent permitted by law, we may:
- require information from you regarding your authorization to access a Unit and the consents you have obtained;
- suspend, restrict, throttle, or terminate your access to the Service or the Software, in whole or in part, including the access of any Operator or any connection to any Unit;
- preserve, and disclose to law enforcement or other authorities, information in our possession (including connection metadata such as identifiers, IP addresses, timestamps, and connection events) where we believe in good faith that disclosure is required by law, by legal process, or to protect the rights, property, or safety of HPDash, our customers, or the public;
- report suspected unlawful activity to the appropriate authorities; and
- take any other action we consider appropriate.
Because session content — screen video, keystrokes, mouse input, transferred files, and audio — is end-to-end encrypted between the Operator Client and the Agent, the Service relays only ciphertext and cannot read, and does not store, session content. Our enforcement is therefore based on connection metadata, account information, and reports we receive, and not on the content of your sessions. The encryption of session content does not relieve you of any obligation under this AUP or applicable law.
For Self-Host deployments, where the Customer operates its own gateway, HPDash does not operate the relay and cannot technically suspend, throttle, or terminate a connection. For those deployments, HPDash's enforcement is limited to the contractual remedies in the Terms — including termination of the Subscription and the license to the Software — and to the indemnification obligations in the Terms, and your obligations under this AUP continue to apply in full.
We are not obligated to monitor use of the Service, but we may do so to the extent permitted by law. Our failure to enforce any provision of this AUP is not a waiver of our right to enforce it later.
8. Reporting Abuse
If you believe HPDash Remote is being used in violation of this AUP — including unauthorized access, covert installation, stalkerware or spyware use, harassment, or other unlawful activity — please report it to report@hpdash.com. Please include enough detail for us to investigate, such as the conduct observed, any relevant identifiers, and dates and times. We may decline to act, or limit our response, where doing so is necessary to comply with law or to protect the rights of others, and we may be unable to access the content of any session.
9. Consequences of Violation
A violation of this AUP is a material breach of the Terms. Without limiting any other right or remedy available to us, a violation is grounds for immediate suspension or termination of your account, your access to the Service, and your license to the Software, without refund of any fees paid, and without liability to you. You will remain liable for all fees accrued through the date of termination. The indemnification obligations in the Terms apply to claims arising out of your violation of this AUP, including any unauthorized access to a Unit, any access to a Unit without the owner's consent, and any other misuse of the Service or the Software.
10. Changes to This AUP
We may update this AUP from time to time. Changes take effect when posted to the Site with an updated "Last updated" date. Your continued use of the Service or the Software after changes are posted constitutes your acceptance of the revised AUP.
